We ensure a dissatisfied consumer can address the grievance by returning a purchase to the consultant for a 100% refund on the product within 7 days of the original purchase. Furthermore, the Consultant has the authority to return the product back to the company within 30 days of purchase. This policy is applicable on partially used products as well, wherein not more than 25% of the product has been used. We want to safeguard your position as a direct seller and ensure you give viable options to the customer under customer satisfaction program to honour his/her request. As a direct seller, you can offer the following:
- 100% refund of the purchase price paid
- Easy exchange with the same or another product of the same value
*Please note that Modicare will not accept the return of the products without relevant Customer Order Receipt, Product Return Form, and the related invoice.
This policy does not apply to products that have been intentionally damaged or misused.
Modicare direct sellers are required to indemnify Modicare for any claim, legal actions, suit, etc. (including Modicare legal fees) which are filed, or which originate because of any failure by the Modicare direct seller to observe this rule.
This warranty does not cover any damage caused by accident, misuse, ordinary wear and tear (includes scratches on steel/gold polish/plating etc.)
We offer Full Money Back Guarantee within 30 days from the date of invoice. For Full Money Back Guarantee, the jewellery should be unused, undamaged and in saleable condition with original tags & packaging. Repair incase of manufacturing defects will be done only within 90 days from the date of invoice. The defective jewellery has to be presented physically along with the original invoice at the time of repair, within 90 days at concerned MSC.
Repairs will take 40 days from the date of submission of the defective jewellery subject to the availability of stocks and other essentials required in carrying out the job.
The packing (jewellery box) will not be the part of the repair policy.
This policy comes into effect from 12th January, 2019.
Modicare Cuckoo Air Purifier warranty
Cuckoo Air Purifier comes with 1+2 years extended onsite warranty from the date of invoice.
Air filter and plastic parts are not covered under the warranty.
Warranty involves repairing of defective product/parts and does not entitle purchaser for the replacement of complete product. The company or its authorized service centers reserves the right to retain any part or parts, or components replaced at its discretion in the event of a defect noticed in the equipment during the warranty period.
In the event of repairs/replacement of any part/parts of the unit, this warranty will thereafter continue and will remain in force only for the unexpired period of the warranty. Moreover, the time taken for the repairs/replacement and in transit whether under the warranty or otherwise shall not be excluded from the warranty period.
Any change of address shall be intimated to the company for continuation of the warranty. Failure to do so will absolve the company of the obligation under this warranty. Charges for installation, uninstallation, inspection, and reinstallation of the product are not covered under the warranty and will be borne by the purchaser.
The warranty will automatically be terminated on the date of expiry of the warranty period.
The cleaning of filter, if applicable in the product, is not covered under the warranty and in the event of filter cleaning and need for subsequent replacement of filter, the charges will be borne by the purchaser.
Filter Maintenance and Replacement Suggestions: Remove the plastic pouch of HEPA filter at the time of installation. The filter life fully depends on the nature of indoor environment and duration of usage. It should never be washed. The darkening of the filter layers is normal due to dust, smoke etc. getting trapped in them.
At times, it may produce some odour and needs to be exposed to bright sunlight for 3 to 4 hours at least once in 30 days. If you feel even after cleaning the outflow of air has dropped by 50% or more then it is time to replace the filter.
THIS WARRANTY IS NOT APPLICABLE IN ANY OF THE FOLLOWING CASES:
1. If purchased through any online shopping portals like Amazon.com, Flipkart.com etc.
2. If the warranty card and/or the invoice is not presented to the authorized personnel at the time of repair.
3. The product is not purchased from Modicare Limited or their Consultants/Representatives.
4. Defects caused by improper use as determined by the company's technician.
5. Modification or alteration of any nature is made in the electrical circuitry.
6. Any prior work is carried out by persons/agency other than authorized by the company.
7. The original serial number is removed, obliterated, missing or altered from the machine.
8. Defects due to cause beyond control like lightning, abnormal voltage, acts of God or while in transit to Service Center or purchaser's residence.
9. Any damage caused due to fire, flood, accident, corrosion, abuse or misuse.
10. The extended warranty offer is valid on purchases made from Modicare Limited.
11. The extended warranty offer will cover the equipment /models in case of any electrical & component failure (excluding consumables & physical damage).
Cuckoo Appliances Private Limited ('Cuckoo') either by itself or through any of its Authorized Cuckoo Service Centers, agrees to provide these maintenance services:
- Corrective and remedial maintenance as decided from time to time by Cuckoo.
- Services to rectify the malfunctioning of the equipment as and when required.
- Electronics and electrical parts covered within Extended Warranty period.
The Customer needs to get the filter changed of their Air purifier only with genuine Cuckoo spare parts/accessories and only through the authorized partners / representatives of Cuckoo. Any damage caused to the product, its outer or internal body due to any act of the user by force or deliberate damage or by falling of the machine by the consumer, will not be covered by this warranty in any case.
In case of servicing at customer's place, the servicing can be done on all working days during normal working hours of Cuckoo's Service Center. The customer shall provide reasonable facilities which may be required for carrying out the servicing without any hindrance whatsoever. Consumable items are subject to normal wear and tear and are not covered by this Extended Warranty.
The product's plastic body is not covered under this warranty and hence, it must be handled with good care to guard against breakage.
During the term of this warranty the customer shall not directly or indirectly open, alter, tamper with the equipment or in any way commit any act which would result in changing the internal operation of the equipment or entrust the servicing of the equipment to any unauthorized personnel as breach of any of these conditions of the warranty will be treated as expired.
The Customer will have no claim against Cuckoo or Modicare under or pursuant to this Warranty in respect of death or injury to the Customer or any other person or loss or damage to any property caused by or due to equipment failure, breakdown, fire, accident or operation/utilization of the goods otherwise than in accordance with the User Guide or by or due to the own negligence of the Customer or by or due to any other cause or circumstances beyond the control of Cuckoo or Modicare.
Cuckoo and Modicare shall not be liable for damage caused by service performed by anyone who is neither the manufacturer of Cuckoo nor a representative of Modicare.
Cuckoo and Modicare shall not be liable for the product or any part thereof if that has been modified without the prior permission of Cuckoo and/ or Modicare.
Cuckoo and Modicare shall not be liable for the product not accompanied by the Sales Invoice. Except as provided in this warranty and to the maximum extent permitted by law, Cuckoo and Modicare is not responsible for any direct, special, incidental or consequential damages resulting from any breach of warranty or condition or under any other applicable law.
SM Watches Warranty
This warranty does not cover the following:
- Normal wear and tear
- Damage caused by mishandling, including damage to the mineral glass or Acrylic crystal and strap or bracelet.
- Damage caused by the watch being opened/disassembled/repaired/formatted/ serviced at an un-authorized service outlet.
- Damage due to water entry as watch is not "Waterproof".
- Plating damage due to exposure to chemical solvents, commercial cleaners, detergents, adhesives, cosmetic sprays etc.
- Plating wear-off on the underside of the metal bracelet.
- Plating damage arising from any misuse or abuse of watch such as scratches, dents or any other physical damage.
- Any consequential damage or loss arising on account of the aforesaid.
- The packaging (watch box) will not be the part of the repair policy.
- Repair in case of manufacturing defects will be done only within 365 days from the date of invoice.
- The repair will be undertaken provided the defective watch is presented to the authorized repair centres accompanied by relevant invoice as a proof of date of purchase/Invoice.
Consultant Uniform Policy
Consultant Uniform is not included in the Monthly Loyalty Program. No refund/return is allowed will be done on Uniform. Size exchange for Uniform will be done only from Modicare Success Centres within 30 days from the date of invoice. In case of size exchange, the uniform should be unused, unwashed, undamaged and in saleable condition with original tags, buttons & packaging.
Modicare Merchandise – (Draft)
Modicare Merchandise (100 PPV Badges, T-Shirts, Cap, SMAP2.0 Parker Pen, Waterman Pen) are not covered under 100% Satisfaction Guarantee, there will be No refund on Modicare Merchandise. Modicare Merchandise products will not attract any PV or BV and will not be included in Monthly Loyalty Program. Size exchange for T-Shirt will be done only from Modicare Success Centres within 30 days from the date of invoice. In case of size exchange, the T-Shirt should be unused, unwashed, undamaged and in saleable condition with original tags, buttons & packaging.
eLearning Courses Policy
Once the order is confirmed against the purchase of eLearning courses available on www.spbmacademy.com, no Refund will be applicable.
Product Return Procedure
The company will accept return of products along with relevant Customer Order Receipt, Product Return Form and related invoice within 30 days of its purchase. In case Modicare direct seller returns a product under 100% Satisfaction Guarantee, he/she will have the option to take Credit note (through which the direct seller can buy same or another product of the same value) or Cash. If amount of refund in lieu of product returned is upto Rs. 1,000/-, cash will be issued immediately by Modicare Centres. However, if amount exceeds Rs. 1,000/-, direct seller will be issued amount in his/ her registered bank account.
Product Return- Other guidelines/notes
This policy will apply on offer invoices as well as product received at discount under offer as follows - Modicare Consultant returning products purchased under offer may take replacement of invoiced products or offer products with same or any other product/s of same value provided offer conditions are not affected otherwise Consultant will seize to get the benefit under the offer.
Product Return Conditions
1. The direct seller must return the product(s) to Modicare Centers.
2. Period of return for products is calculated as the number of days from the Invoice Date to the date of receipt at the Modicare centre.
3. The product will be considered as 'Saleable' or 'unsaleable' depending on the condition of the returned stock as assessed by the Returns executive at the Modicare Centre.
4. PV/BV adjustment of Products returned up till 25th of each month shall be processed in the same month. Total PV/BV of the returned products will be deducted from the returning direct seller's account.
5. The Product Satisfaction Guarantee does not apply to open packs of literature and videos or other sales aids.
6. Total returns cannot exceed the quantity appearing on the Invoice.
7. If products are returned by customers directly to Modicare, PV/BV adjustment shall be done from the direct seller's account & any excess amount paid shall be recoverable from the direct seller.
8. Taxes means all taxes levied on Sales in India.
9. Saleable refers to products that are unopened and sealed and are in “Good to sell” condition.
10. Unsaleable are products which have been partially used (upto 25%). However, the condition for partially usage of the product doesn't apply in case of electronic products, accessories or any other product as decided by Modicare from time to time e.g. Imitated Jewellery (under ‘Amoli’ brand), Modicare Cuckoo Air Purifier, SM Watches, Merchandise, Modicare Premium Protection Mask, Modicare Envirochip & Enviroglobe, Mighty Guard, 3 in 1 Fast Charging Cable etc. For the sake of clarification, the return against the aforesaid products can only be accepted if they are in Saleable condition only, subject to the verification by Modicare
11. Excess stock refers to products greater than or equal to six in number.
Exchange Of Product In Case Of It Being Defective
In case a direct seller/ customer found any product being defective, he/ she shall bring it to our nearest Modicare Centre and gets it replaced with the same product or any other product of same value or get the refund.
